A Brazilian court has rejected a request by the country’s health authorities to prohibit the sale of Viagra, the world’s second-biggest drug, following a lawsuit by men accused of taking the drug.
The court decision could potentially discourage the drug’s sales, especially among men who already have erectile dysfunction. The Brazilian Justice and Judicial Commission for the Protection of Human Rights (HBPR) has asked the court to order the drug’s suppliers to stop selling it.
HBPR Chairman André Bousquet said that “a decision is being taken by the court”.
“We believe that the Brazilian Ministry of Health is in a position to decide this matter,” Bousquet told ABC News in an interview. The Ministry has also said it has decided to prohibit the sale of the drug.
“In the first half of this year, the government will issue a directive to the public to take into account what was discussed in the press release and what was discussed at the press conference.”
Bousquet also said that the public health authority of Brazil is not going to take into account what is discussed in the press release. He said that he will ask the authorities to stop selling the drug and not to approve it. However, he said that “in Brazil, where we are a country of more than 10 million people, we are not going to be taking into account what was discussed in the press release”.
The drug’s manufacturer, Bayer AG, is in the middle of a case that has gone to the Federal Court.

“What is that about?” he asked. “Why would we be making any kind of an offer to the public of selling a drug that’s already available in the country? It’s a very serious issue.”
Bousquet said that he would not allow the authorities to use any kind of “anti-fungal” drug, including the drug, to sell Viagra.
“This is the first time that I’m talking to the Brazilian public, and I’m talking to the people of Brazil,” said Bousquet. “We believe that there’s no such thing as a public health authority, no matter how small, that decides what is available to the public in the country.”
The company said that it has “not engaged in any kind of criminal or criminal conduct that could put the public at risk.”
In response to a question about the legal implications of the decision, the company said that it would appeal the decision.
“There is no reason to take the case to the court. That’s a serious matter,” said the company. “We want to make sure that it is not a case that’s going to interfere with the health of the public in Brazil.”
